General section- please note that this section relates generally to your use of our site and to all products purchased.
This is the user agreement which governs your use of this website and the purchase by you of the services and products that we provide. The website is owned and operated by Holiday overseas Ltd (‘Holiday Overseas Rentals" and in this document may be referred to as "we" or "us") however the products and/or services we promote are not supplied by us and therefore the contract for the product and/or service will be between you and that third party.
Please take time to read these terms and conditions as it is important for all parties that you understand our contractual relationship relating to your use of our site. We will not allow you to purchase any products from our site unless you have confirmed that you have read these terms.
Our site operates as an agency model for rental property and we are advertising services for property owners, search facilities for accommodation, properties for sale by vendors and golf club facilities. We do not own, inspect or provide content for any of the properties advertised on our site. We also act as a disclosed agent for third party suppliers, such as letting agents or property owners. What this means is that the contract for the product is between you and the supplier. In most cases this will mean that there are additional terms and conditions governing the contract as each supplier may have terms and conditions relating to that product.
Please make sure that you have read these terms and conditions before completing your transaction with us. You can easily request a copy of them from our Customer Services department. Please refer to our Terms and conditions and understand that we act as an agent and this means that we have no contractual liability to you in respect of that product. However, we may still be liable to you if we have been negligent; have misrepresented important information or have been in breach of any other relevant law.
We take responsibility for ensuring that any payments made are processed and forwarded to the product providers but have no contractual liability to the purchaser for the return of any payments made in the event of the product not being as advertised, not available as advertised or in the event of any dispute between the customer and product provider.
All products sold through Holiday Overseas Rentals are not an offer by Holiday Overseas Rentals but an invitation to you to make an offer to our suppliers. We are free to accept that offer on behalf of those suppliers or to reject it. We will send you an email acknowledging receipt of your order and once we have processed your order, we will send you an e-mail confirming the contract.
Because the contract for the product is between you and the supplier any queries or concerns relating to the product should be addressed to them. You will see the name and address, plus contact details for supplier in the 'log in' section when you click on 'Bookings' in the panel on the left. We will of course assist you with this if you wish - please contact us through contact form.
Your contract is not with Holiday Overseas Rentals but with a third party supplier such as a property owner or letting agent and Holiday overseas Rentals may pass your booking details to that third party. The placing of an order for any products and services by you will constitute consent to us passing on such details. However we will not pass your credit card or debit card details to ANY third party.
Please make sure that you have read and understood the Terms and conditions before you confirm purchase, it is your responsibility to make sure you have done so.
You undertake to us that the details you give to us while using the website are correct in particular that the credit or debit card you are using is your own (or you have permissions to use it) and that there are sufficient funds to cover the cost of the product or service. If there are any changes to the details supplied to us by you it is your responsibility to inform Holiday Overseas Rentals via our web form as soon as possible. We won't send you e-mails which you do not want but we can't guarantee that third parties to whom your details are sent will not do so.
Our website will not stop you from making impossible bookings such as bookings to different places at the same time. If you make such a double booking we will not be able to offer you a refund.
We will do our best to correct errors and omissions as quickly as practicable after being notified of them. However because of the sophisticated technology that is required in operating Holiday Overseas Rentals there may be times when obvious errors occur. For example, very occasionally, this may result in a price, product or service or other detail displayed or presented on our site being incorrect. In this case we reserve the right to cancel that contract, but this of course will be without any liability to you.
Holiday Overseas Rentals does not make any warranty that the website is free from infection by viruses or anything else that has contaminating or destructive properties.
Credit card companies charge us a fee when you pay with their cards and therefore a credit card fee is applied to some accommodation bookings.

Definitions and interpretation
'The contents' means the furniture and other movable items (some of which are advertised on our site under specific property) which are let with the property under this agreement.
'The property' means the property described in the booking form.
‘The rent ‘means the rent set out in the particulars or the booking form.
‘The term' means the period for which the property is let under this agreement as specified in the particulars and / or booking form.
Where "the guest" consists of two or more persons, obligations expressed or implied to be made by all with them are deemed to be made by or with those persons jointly and severally (this means that they will each be liable for all sums due under this agreement and not just a proportionate part and all agree to all terms and conditions set out by us and other third parties.)
Words that indicate one gender include the other gender, words that indicate the singular include the plural and vice versa, and words that indicate persons shall be interpreted as extending to a corporate body or a partnership.
To secure a booking you must fill in all the relevant fields on the online booking form and then wait for us to send you an e-mail confirming that booking.
Please note that accommodation is sold "subject to availability" what this means is that you can check the availability on our site and proceed with the booking if the dates required are available. However we do not confirm your order immediately (your first confirmation e-mail will just be an acknowledgment of order) but we will ensure that the accommodation is available, if it is we will book it for you, if it`s not we will revert to you. Please see the 'Check availability' link for each "subject to availability" accommodation for more details"
When you book accommodation please remember that, in addition to these terms and conditions, you will be subject to the terms and conditions of the third party supplier, such as a property owner or letting agent. Please contact our Customer Services who will be able to provide those terms and conditions to you (although they may also be attached to the property advertisement).
Where the supplier of the accommodation allows you to cancel or modify the booking you must contact Holiday Overseas Rentals in writing to confirm the change. Unless we receive such a written request Holiday Overseas Rentals will be unable to affect that request. Please note that because the contract for the accommodation is between you and the supplier, Holiday Overseas Rentals have no discretion in deciding whether the accommodation can be cancelled or modified.
Only those persons whose name appears on the Booking form may use the property. The number of persons (adults and children) must not exceed the number of sleeping places indicated on the website. The substitution of persons during the rental period is forbidden unless previously agreed.
Arrival/ check in time is 3pm on the arrival date booked (unless alternative times are specifically arranged). Please check with us or the owner/letting agent the few days before your arrival date and where possible we will be happy to arrange a variation on the arrival time.
Departure/ check out time is 11am on the departure date. The company has some flexibility provided that there are no imminent new arrival. Please check with us or the owner/ letting agent and where possible we will be happy to oblige.
We take a 50% deposit payment (‘deposit') of the full letting charge by credit / debit card or PayPal when you book.
You must make the 50% balance payment via Holiday Overseas Rentals at least eight weeks prior to the arrival date. The date when the balance payment is due will be clearly stated in the confirmation email and in your on line account. If payment is not received by the company in full and by 7 days after the date given in our confirmation email, then the company reserves the right to treat booking as cancelled. In these circumstances the cancellation charges set out in this agreement will be applicable. If we have not received full payment 8 weeks prior to arrival date reminders of necessary payment will be sent twice between 8 and 7 weeks prior to the arrival date stated in the booking form. If after 7 days following the eight week point the full payment is not received the reservation will be cancelled without refund to the guest.
Bookings received eight weeks or less before the arrival date to the property will be paid in full at the point of booking.
Although Holiday Overseas Rentals does not anticipate any costing errors on the confirmation invoice, should an incorrect price be shown then the company will issue a new invoice and will not be bound by the price shown on the incorrect invoice.
We reserve the right to change our prices at any time before you book. If we do you will be told of the revised price applicable to your booking before you commit yourself. As soon as you have paid full payment and your booking has been confirmed we guarantee that the price of accommodation will not be subject to any surcharges or amendment.
Accommodation Cancellations / Amendments
In the event that you would like to cancel or amend your booking, the cancellation policy will be available in "log in" section, on your confirmation email and as stated at the time of booking.
If the cancellation policy is not displayed within your confirmation email and you wish to cancel your reservation, it is your responsibility to notify Holiday Overseas Rentals verbally or in writing.
Holiday Overseas Rentals applies an administration charge fee of £20 per booking for any modifications (such as dates or term of occupancy) to your reservation (any credit card charges are non-refundable) if indeed these modifications can be accommodated.
In addition to Holiday Overseas Rentals charges, most property owners and agents may also have an admin or cancellation fee for any changes or cancellations to reservations.
If you send us your cancellation in writing or email, cancellation is not immediate, Holiday Overseas Rentals will usually respond to you within 6 hours of receipt of your email or letter. Please take our turnaround time into consideration when putting your cancellation in writing.
All accommodation discounts advertised are based on the discounts from the full including VAT (where applicable) price and are correct at the time the offers are first advertised on our site.
Prices stated are on per property, per night and per week basis and include VAT (if applicable) unless otherwise stated.
Unless otherwise stated, breakfast, lunch and dinner are not included.
Please note foreign property advertisements displayed on the UK website of holidayoverseasrentals.com will be stated in GBP sterling (£) and payable in GBP sterling (£).
If you wish to convert any amount advertised to another currency there is a currency converter on the web site.
Whilst every effort has been made to ensure accuracy and availability, some errors may still occur. Once aware of such incidents we will make all reasonable effort to advise you within 48 hours of the booking being made. We reserve the right to cancel the reservation and refund all monies paid and this of course will be without any liability to you.
In the unlikely event of the supplier cancelling or amending your reservation after the booking has been made, we will make all reasonable effort to advise you as soon as possible. Should the supplier be unable to fulfil your accommodation reservation, you will have the choice of accepting an offered alternative or cancelling your reservation with a full refund of all monies paid. In cases where we or the supplier are unable to provide an alternative, we reserve the right to cancel your reservation with a full refund.
In the unlikely event that the property, having been reserved for a guest, can no longer be let due to unforeseen circumstances (for example because of fire or flood) then the guest should be aware that a full refund will be given. If the cause of the problem is due to travel restriction, (such as strike action by third parties or anything outside of the control of the property owner) then the guest should refer the matter to their travel insurers as the property owner nor Holiday Overseas Rentals cannot be held responsible.
If you wish to cancel your booking for any reason we must be notified in writing. Cancellation will be deemed to occur on the day we receive this cancellation request so you may want to use recorded delivery or email.
The cancellation terms of Holiday Overseas Rentals are detailed within this document.
If you have taken out travel insurance and the reason you are cancelling is covered by that insurance, you should be able to obtain payment of these cancellation charges (after deducting any part of the claim which the insurance company insists you pay) from your insurance company. You must pay the cancellation charges at the point of cancellation and then claim form your insurance. Please make sure you get written confirmation of your cancellation from us - this proves we have received your cancellation and you will need it to make a claim on your insurance.
The guest may cancel the booking at any time. Cancellation must be communicated to Holiday Overseas Rentals in writing (which includes email) and will take effect from the date received by the company. In the event of cancellation the following charges become payable.

If you fail to pay the balance of the rental within one week of the balance being demanded by Holiday Overseas Rentals or the owner, Holiday Overseas Rentals may cancel the booking and in such circumstances no refund of the deposit monies paid to date shall be payable to the guest. We have a responsibility to our owners to give them the maximum opportunity to find alternative guests for the period of time that you have reserved.
It is the responsibility of the guest to ensure that their personal possessions are insured. The company accepts no liability for theft, loss or damage to the personal possessions of the guest or any members of their party. We also recommend that guests arrange adequate travel insurance to include it possible cover in case of cancellation.
It is recommended that in all cases the guests take out adequate travel insurance through an approved insurance supplier.
1. Not to deface, make any alterations or additions to the interior or exterior of the property or to the decoration, fixtures or fittings of the property or to the contents.
2. To keep the furniture, soft furnishings and equipment in their present state of repair and condition and to replace with similar articles of at least the equivalent value and standard any items which may be found to be missing or destroyed (reasonable wear and tear excepted)
3. Not to remove any of the furniture from its present position in the property
4. Not to do or permit to be done anything which may be a nuisance or annoyance or cause of damage to any neighbouring or adjoining property/ies.
5. Not to do anything or suffer or permit anything to be done as a result of which any policy of insurance held by the owner in respect of the property or its contents may become void or voidable or subject to an increased rate of premium
6. Not to use the property for any illegal or immoral purposes
7. Not to play or permit to be played in the premises any musical instrument or sound production equipment between 11 pm and 7:30 am or so as to be audible outside the property (there may also be additional local restrictions in addition to this criteria).
8. Not to smoke or permit smoking inside of the property
9. Not to allow pets inside the property without the express written permission of the owner. The guest will be responsible for any damage caused by the pet.
10. On completion of the letting period the guest agrees to leave the property and the furniture and its contents in a clean and tidy state of repair and condition and in accordance with the provisions of this agreement.
For this purpose you have been requested to deposit the sum of £200 against extraordinary cleaning or repair costs. If all or part of this sum is not required it will be refunded to you within 7 days of the end of your letting period.
11. By completing the booking form on the website the guest agrees the price for the holiday letting period and confirms that they have read, understand and agree these terms of letting.
12. For all bookings the guest must complete the booking form, provide a contact address, telephone number and e-mail address and delivery address for the purpose of key collection prior to the start of the holiday letting period.
13. The guest will contact the company if he is interested in renting the property for a period exceeding four weeks (the website will not accommodate this). Special negotiated rates may be available for longer rental periods.
14. The lead guest must be over 18 years of age and authorised to make the booking.
15. The guest may not assign the letting or part with or share possession of the property with any other person not stated on the booking form without prior consent.
16. The guest agrees that Holiday Overseas Rentals may forward their contact address to the owner of the purpose of key collection.
17. Arrival/check in time is 5 pm on the arrival date booked (unless alternative times are specifically arranged). Please check with us the few days before your arrival date and where possible we will be happy to arrange a variation on the arrival time.
18. Departure/check out time is 11am on the departure date. The company has some flexibility provided that there are no imminent new arrivals. Please check with us and where possible we will be happy to oblige.
19. The guest will be responsible for the owner's reasonable costs for removal and storage of any possessions left in the property after departure. If the guest does not collect such possessions within 28 days of departure then they will be disposed of by the owner without further notice and at the cost of the guest.
The Company's Liability to you
1. We accept liability for matters which arise as a result of our negligence and/or breach of our contractual duty to exercise care in making arrangements for you, including any acts or omissions by our employees or agents.
2. It is also important to note that if cancellation of your arrangements occurs by reason of unusual and unforeseeable circumstances beyond our control or that of our suppliers, the consequences of which could not have been avoided even if all due care had been exercised (such as war, a state of war, riot, fire, civil strife, industrial action, terrorist activity, natural or nuclear disaster, adverse weather conditions or other conditions amounting to force majeure) we will not be liable. In these circumstances we will also not pay any resulting expenses or additional costs.
3. We attempt to ensure that the information available on the website at any time is accurate. However, the Vendor remotely uploads product names, details and descriptions via an extranet facility. This means that Holiday Overseas Rentals cannot guarantee the accuracy of such information. We cannot be responsible for updating such information and we cannot guarantee that it will be fault-free.
4. We cannot be responsible for services offered by us as agents for third party Vendors or for any aspect of the relationship between you and that third party.
5. Holiday Overseas Rentals does not accept liability (except as set out below) for any errors or omissions and reserves the right to change information, specifications and descriptions of listed goods, products and services at any time.
6. We will do our best to correct errors and omissions as quickly as practicable after being notified of them.
7. Holiday Overseas Rentals does not make any warranty that the website is free from infection by viruses or anything else that has contaminating or destructive properties.
8. Holiday Overseas Rentals does not accept any liability for any losses or claims arising from any inability to access the website, any interruption in the conduct nor for any failure to complete a transaction.
9. Holiday Overseas Rentals does not accept liability for any indirect or consequential loss of any kind in contract, tort or otherwise arising out of the use of the website or for any products or services purchased from the website.
Holiday Overseas Rentals shall not be responsible for:
1. The management of the property.
2. Furniture and furnishings complying with relevant fire safety regulations.
3. The checking of any appliance, installation pipework or flues in the property.
4. Electrical appliances and equipment.
5. Any act by a third party which may prevent or disrupt a guest's booking.
6. That the owner holds any guest liability insurance.
If you have a complaint regarding the accommodation you must tell the relevant supplier (e.g. property owner) and Holiday Overseas Rentals immediately. Most problems can be solved on the spot but if after you return home you are still not satisfied you must write to our customer relations department on your return.
It is unlikely that you will have a complaint that cannot be settled amicably between all parties, however, if this is not the case it should be noted that any dispute will be between the guest and the property owner and it is acknowledged that Holiday Overseas Rentals is simply acting as an agent of the owner and the company will not act for either the guest or the property owner in such disputes if the issue cannot be resolved amicably.
Brochures and Web Sites
Every effort has been made to ensure the accuracy of our website in relation to property descriptions and other information. However, we are not always able to control all of the components of the accommodation and it is possible that an advertised facility may be withdrawn or changed, due to weather conditions, lack of demand or for maintenance, renovations etc. We will advise you if we become aware of a major change. We will make all reasonable efforts to inform you of any changes at any stage in your booking prior to travel.
When you travel overseas, all requirements should be checked with the relevant Embassy of the destination country. Some overseas countries have an immigration requirement that your passport is valid for a minimum period after you enter that country, typically 6 months. If your passport is in its final year of validity, we advise you to confirm the requirements of the destination before making final travel plans. You should apply for a passport or to renew an expired passport at least four weeks before travelling. The UK Passport Agency can provide further information at: www.ukpa.gov.uk
Children not already included on a valid British passport will need to hold their own passport if they are to travel abroad. Children who were included on a passport before 5 October 1998 may continue to travel with the passport holder until: * the child reaches the age of 16; or* the passport on which the child is included expires; or * the passport on which the child is included is replaced or an amendment results in the issue of a new passport
You should contact your Embassy for information and advice on the visa requirements of the countries you propose to visit. Please note: Passport and visa regulations can change and you should therefore check with the relevant embassy well in advance of travel, even if you have travelled to this destination before. It is your responsibility to be in possession of a valid passport and, if appropriate visa. It can often take some time to obtain a visa, so you are advised to apply in plenty of time. We accept no responsibility for customers who do not possess the correct documents.

8. The Vendor of the property or accommodation is not Holiday Overseas Rentals but a third party such as a property owner/ letting agent. Holiday Overseas Rentals may pass on your booking details to that third party. The placing of an order by you for any services will constitute your consent to us passing on such details.
9. Holiday accommodation purchased through Holiday Overseas Rentals may be subject to additional terms and conditions of the property owner/ letting agent however the property owners/ letting agent have accepted cancellation policy in this document.
10. The agreement is made on the basis that the property is to be occupied by the guest for a holiday as mentioned in the Housing Act 1988 schedule 1, paragraph 9 and the guest acknowledges that this agreement is not an assured tenancy and that no statutory periodic tenancy will arise on the termination of the letting period
11. As a holiday letting, this agreement is an excluded agreement for the purpose of the Protection from Eviction Act 1977.
12. It is the intention of the owner and the guest during the term of this agreement that the occupation by the guest of the property is the purpose of a holiday let only and that the guest occupies the premises solely on the this basis and that this agreement shall take effect as a holiday letting agreement only.
13. Bookings are made in good faith by the Holiday Overseas Rentals and may be subject to changes as notified by the owner prior to commencement of the occupation of the property. Holiday Overseas Rentals will not be liable for actions taken by the owner of the property including, for example, if the property should be sold or repossessed or the booking cancelled. Such circumstances are rare but should they arise the Holiday Overseas Rentals will use every reasonable endeavour to make alternative accommodation available.
14. The Holiday Overseas Rentals accepts no liability for the owner's description of the property. Any information is given in good faith. Tables quoted are correct at the time of printing and are subject to change without notice. Properties can be viewed from our website at www.holidayoverseasrentals.com
15. Holiday Overseas Rentals shall not be liable to the guest in tort, contract, negligence, breach of statutory duty or otherwise for any loss, damage, costs or expenses of any nature of an indirect or consequential nature including without limitation any economic loss or other loss of turnover, profits, business or goodwill.
16. Any Visa, Passport and inoculation requirements are your responsibility and failure to obtain the relevant documentation and inoculations is not the responsibility of Holiday Overseas Rentals or the Vendor of the products or services.
17. We will not send you e-mails that you do not wish to receive but we cannot guarantee that third parties to whom your details are sent will not do so.
18. The copyright in this website belongs to Holiday Overseas Rentals. All other intellectual property rights are reserved. This website is for personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information obtained from this website. You may only download to your personal computer for viewing purposes and print out pages from this website for your personal use.
19. Holiday Overseas Rentals assumes no responsibility for the contents of any other websites to which the holidayoverseasrentals.com website has links and shall not be held responsible or liable for any loss or damages caused or alleged to have been caused or alleged to have been caused by use of or reliance on any content, goods or services available on such hyperlinked sites. Holiday Overseas Rentals may not have control of such websites.
